Here is the short version. Training Brazilian Jiu-Jitsu is a physical contact activity, and you take part at your own risk. These terms cover who can train, how membership and payments work, how we expect people to behave on the mats, and the ground rules for using our website and our texts. When you enroll, attend a class, book online, or use mollisarsbjj.com, you agree to everything on this page. Please read it in full.
1. Acceptance of These Terms
These Terms of Service (“Terms”) form a binding agreement between you and Mollis Ars BJJ LLC (“Mollis Ars BJJ,” “we,” “us,” or “our”), which operates the Brazilian Jiu-Jitsu academy located at 222 S Washington Ave STE C, Cleveland, TX 77327 and the website at mollisarsbjj.com.
By enrolling in a program, attending a class or event, creating an account, booking through our site, or otherwise using our services or website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services or website.
2. Who We Are and What We Provide
Mollis Ars BJJ operates a martial arts academy offering Brazilian Jiu-Jitsu instruction and related programs for preschoolers, children, teens, and adults, including group classes, private lessons, seminars, and community events.
Class schedules, program details, and availability are described on our website and may change. Participation in any program is subject to these Terms, any separate membership or enrollment agreement you sign, and the academy rules posted on-site or communicated by our instructors and staff.
3. Assumption of Risk
Brazilian Jiu-Jitsu is a physical, full-contact grappling activity. Please read this section carefully.
Training, sparring (rolling), drilling, and competition involve close physical contact and carry an inherent risk of injury. These risks include, without limitation, bruises, cuts, sprains, strains, joint injuries, dislocations, fractures, concussion, skin infections, and in rare cases serious injury, permanent disability, or death. Some risks are inherent to the sport and cannot be eliminated regardless of the care taken.
By participating, you knowingly and voluntarily accept and assume all risks of injury, whether caused by your own actions, the actions of training partners, the condition of the facility, the negligence of others, or otherwise, and you confirm that you are participating of your own free will.
4. Health and Fitness Acknowledgment
You represent that you are in good health and physically able to take part in strenuous physical activity, and that you have no medical condition that would make participation unsafe. We recommend that you consult a physician before beginning any new physical training program.
You are responsible for stopping activity and notifying an instructor if you feel unwell, experience pain, or believe that continuing would be unsafe. You are also responsible for disclosing any communicable skin condition or illness and for staying off the mats while contagious.
5. Release and Waiver of Liability
To the fullest extent permitted by Texas law, and in consideration of being permitted to participate, you (and, where applicable, your heirs, family, and personal representatives) release, waive, and agree not to sue Mollis Ars BJJ LLC and its owners, instructors, employees, agents, and affiliates (the “Released Parties”) from any and all claims, demands, liabilities, or causes of action for injury, death, illness, or property loss arising out of or related to your participation in any Mollis Ars BJJ program, class, event, or use of the facility, including claims based on the ordinary negligence of the Released Parties.
This release does not apply to conduct that is grossly negligent, reckless, or intentional, or to any liability that cannot be waived under applicable law.
6. Minors and Parental Consent
Some of our programs are for children and preschoolers. If you enroll a minor, or if a minor participates in any program, you represent that you are the parent or legal guardian with authority to act on the minor's behalf.
You agree to these Terms, including the Assumption of Risk and Release and Waiver of Liability sections, on behalf of yourself and the minor. You accept responsibility for the minor's conduct, for ensuring the minor follows academy rules, and for supervising the minor before and after class in accordance with academy policy.
7. Eligibility and Accounts
To enter into a membership or enrollment agreement, create an account, or make a purchase, you must be at least 18 years old. Minors may participate only through a parent or legal guardian as described above.
You are responsible for keeping any account credentials secure, for all activity under your account, and for providing accurate and current information.
8. Membership, Fees, Payment, and Cancellation
Program fees, membership rates, billing cadence, and cancellation terms are those presented to you at the time of enrollment and set out in your membership or enrollment agreement. Some memberships are sold on a recurring basis and will bill automatically at the interval and amount stated in your plan until cancelled in accordance with your agreement.
You authorize us and our payment processor to charge your selected payment method for the fees and recurring charges that apply to your plan. Unless your written agreement states otherwise, payments are non-refundable. To change or cancel a membership, follow the cancellation method described in your agreement or contact us using the details in the Contact section. You remain responsible for charges incurred before a cancellation takes effect.
9. Code of Conduct
Mollis Ars BJJ is committed to a respectful, safe, and inclusive training environment. While on our premises or taking part in our programs, you agree to follow instructor and staff directions at all times, train within your own and your partners' skill levels and physical limits, maintain proper hygiene and clean gear, and treat every member, guest, and staff person with respect.
We do not tolerate discrimination, harassment, bullying, intimidation, unsafe behavior, or use of the academy's training for unlawful purposes. Attending class under the influence of alcohol or drugs is prohibited. We may refuse service, or suspend or terminate participation, for conduct that violates these standards or endangers others.
10. Website Use
When using mollisarsbjj.com, you agree not to interfere with the site's operation or security, attempt unauthorized access, scrape or harvest data, upload malicious code, or use the site in any way that violates law or these Terms.
11. Intellectual Property
All content on mollisarsbjj.com and in our materials, including the Mollis Ars BJJ name, logo, text, graphics, photographs, videos, and layout, is owned by or licensed to Mollis Ars BJJ LLC and is protected by intellectual property laws.
You may view and use the site for your personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
12. Photography and Media
We may photograph or record classes, events, and activities for instructional, promotional, and community purposes. By participating, you consent to being photographed or recorded and to our use of that media across our website, social media, and marketing, without compensation, unless you notify us in writing that you wish to opt out.
If you submit reviews, testimonials, photos, or other content to us or about us, you grant Mollis Ars BJJ a non-exclusive, royalty-free license to use, display, and share that content in connection with our business, and you represent that you have the right to share it.
13. Communications and Text Messaging
By providing your phone number and opting in, you consent to receive calls and text messages from Mollis Ars BJJ, including through automated technology, about class schedules, seminars, community events, account and appointment updates, and promotions. Our messaging program sends approximately 4 to 5 messages per month, and message frequency may vary. Message and data rates may apply.
Consent to marketing messages is not a condition of enrolling in any program or purchasing any service. Reply STOP to opt out at any time, or reply HELP for help. You may also reach us at (346) 731-3262. We honor your local time zone and do not send marketing messages between 9 PM and 8 AM. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Carriers are not liable for delayed or undelivered messages. 14. Third-Party Links and Services
Our website and booking tools may link to or rely on third-party services, including scheduling, payment, and communication platforms. We are not responsible for the content, policies, or practices of third-party services, and your use of them is governed by their own terms and privacy policies.
15. Disclaimers
Our services and website are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Mollis Ars BJJ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the website will be uninterrupted, secure, or error-free, or that any particular training result, fitness outcome, or belt progression will be achieved. Progress in Brazilian Jiu-Jitsu depends on many factors within your control.
16. Limitation of Liability
To the fullest extent permitted by Texas law, and except for liability that cannot be limited by law, the total liability of Mollis Ars BJJ LLC and the Released Parties for any claim arising out of or related to these Terms, your participation, or your use of our website will not exceed the total amount you paid to us in the twelve months before the event giving rise to the claim.
Mollis Ars BJJ will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, even if advised of the possibility. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
17. Indemnification
You agree to indemnify and hold harmless Mollis Ars BJJ LLC and the Released Parties from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of or related to your participation, your violation of these Terms, your violation of any law or the rights of another, or the participation of a minor you enrolled.
18. Termination
We may suspend or end your membership, participation, or access to our website at any time for conduct that violates these Terms, endangers others, or is disruptive to the academy, consistent with the terms of your membership or enrollment agreement. You may stop using our services and cancel your membership as described in your agreement.
Sections that by their nature should survive termination, including Assumption of Risk, Release and Waiver of Liability, Disclaimers, Limitation of Liability, and Indemnification, will survive.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or related to these Terms or our services will be brought exclusively in the state or federal courts located in Liberty County, Texas, and you consent to the personal jurisdiction of those courts.
20. Dispute Resolution
If a dispute arises, we ask that you first contact us so we can try to resolve it informally. Please send a written description of the dispute and your contact information to [email protected], and we will make a good-faith effort to resolve it.
If we cannot resolve the dispute within a reasonable time, either party may pursue the matter in the courts identified in the Governing Law and Venue section.
21. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date shown at the top of this page. Your continued participation in our programs or use of our website after changes take effect means you accept the updated Terms.
